1. Who we are and acceptance

This website and the Zenius platform are operated by Smartintent AI Solutions Private Limited, a company incorporated in India with its registered office at T-18, Plot No. 9B & 9C, Cross River Mall, Shahdara, Delhi 110032, India, trading as Zenius QA ("Zenius", "we", "us"). Our US office is at 221 Camille St, Leander, TX 78641, USA.

By using the website or creating a platform trial account you accept these terms and our Privacy Policy. If you use them on behalf of an organisation, you confirm you have authority to bind it, and "you" means that organisation. If you do not agree, do not use the website or the platform.

2. Using the website

You may browse the website and use its content — including the sample verdict, the ROI calculator and the comparison pages — for your own evaluation of our services and for internal business purposes such as circulating them within your organisation. The ROI calculator produces estimates from assumptions you control; it is not financial advice and we make no warranty that outcomes will match its outputs. Comparison information about other vendors is compiled from their public materials as of the date shown and may become out of date; verify it with the vendor before relying on it.

You must not use the website in a way that damages or impairs it, attempt to gain unauthorised access to it or its infrastructure, scrape it at scale, or frame or mirror it without our written consent.

3. Platform trial accounts

The free tier of the Zenius platform ("Find a Zenius") lets you connect a repository so that the Zenius agent can map critical flows, generate tests from your acceptance criteria and our library, run them and report results. Trial accounts are provided for evaluation, are limited in scope and volume at our discretion, and may be withdrawn or changed at any time. You are responsible for keeping your credentials confidential, for everything done under your account, and for ensuring you have the right to connect the repositories and environments you connect.

Paid tiers and managed services are provided under a separate agreement. Nothing in these terms obliges us to enter into one.

4. Acceptable use — and testing only what you are allowed to test

Because Zenius runs automated tests and load rehearsals, this clause matters more than usual. You agree that you will:

• only connect, test, load-test or otherwise exercise systems, environments and accounts that you own or are expressly authorised to test, and that you will obtain and keep written authorisation for any environment owned by someone else — including a hosting provider's, a payment gateway's or a partner's — where their terms require it;
• never use the platform or our services to test, probe, overload or attack systems belonging to third parties without their authorisation, or to circumvent security controls, rate limits or access restrictions;
• not upload or expose production personal data, payment card data, credentials or other secrets except through the secure mechanisms we agree, and not use real payment instruments in tests unless a signed engagement expressly permits it;
• not use the platform to build a competing service, to reverse engineer, decompile or extract our test library, agent prompts, models or source code, or to remove proprietary notices;
• not upload unlawful, infringing or malicious content, and comply with all applicable laws, including export-control and sanctions laws.

We may suspend accounts and runs immediately if we reasonably believe this clause has been breached, and we may notify affected third parties or authorities where the law requires it.

5. Your content and our intellectual property

Your content. You keep all rights in the code, data, environments and materials you connect or provide, and in the results the platform produces from them. You grant us a limited, non-exclusive licence to access and process them solely to provide the platform and services to you and to keep them secure.

Tests created for you. Under a paid engagement, tests, configuration and evidence created for you are yours, delivered in open formats and exportable at any time, as set out in the Statement of Work. On the free tier, generated tests are submitted to your repository and you may use them for your own internal purposes.

Our platform and library. The Zenius platform, the Zenius agent, our test-case library and its structure, our methods, documentation, reports' formats, trademarks (including "Zenius" and "Zenius QA") and this website's content are owned by us or our licensors and protected by intellectual-property laws. Except as expressly permitted here or in a signed agreement, no rights are granted. Other names and marks on this site belong to their owners and are used for identification only.

6. Confidentiality and feedback

We treat what we learn about your systems as confidential and use it only to provide the service; a mutual NDA is available before any evaluation. Information you submit through the website that you mark or we should reasonably understand as confidential is handled the same way. If you give us feedback or suggestions about the platform, you agree we may use them without restriction or payment, without identifying you.

7. Third-party links and services

The website links to third-party sites and sources (for example vendor pricing pages and industry surveys). We are not responsible for their content or practices. The platform integrates with third-party services such as source-control providers and CI runners under their own terms.

8. Disclaimers

The website and the free tier are provided "as is" and "as available", without warranties of any kind, express or implied, including of merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law. Testing reduces risk; it cannot eliminate it. A verdict, a coverage number or a rehearsal result is a professional assessment based on the scope agreed and the information available, not a guarantee that software is free of defects or will perform in production. Warranties for paid services are set out in the applicable agreement.

9. Limitation of liability

To the fullest extent permitted by law, Zenius and its affiliates, officers, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data, goodwill or business opportunity, arising from or related to your use of the website or the free tier, even if advised of the possibility. Our total aggregate liability for the website and the free tier is limited to one hundred US dollars (USD 100). Nothing in these terms limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence. Liability under paid engagements is governed by the applicable agreement.

10. Indemnity

You will defend, indemnify and hold harmless Zenius and its affiliates from claims, losses and expenses (including reasonable legal fees) arising from your breach of clause 4, from content you provide, or from your use of the platform against systems you were not authorised to test.

11. Suspension and termination

You may stop using the website at any time and may close a trial account by emailing us. We may suspend or terminate access to the website or the free tier at any time for breach of these terms, for security reasons, or on reasonable notice for any other reason. Clauses that by their nature should survive — including 5, 6, 8, 9, 10 and 12 — survive termination.

12. Governing law and disputes

These terms, and any dispute arising from the website or the free tier, are governed by the laws of India, and the courts at New Delhi have exclusive jurisdiction, without prejudice to any mandatory consumer or other rights you have under the laws of the country where you live. Paid engagements may specify a different governing law and forum in the signed agreement — for example the laws of the State of Texas for customers contracting through our US office.

13. General

We may update these terms; the date at the top shows the current version and continued use after a change means you accept it. If any provision is found unenforceable, the rest remains in effect. These terms, with the Privacy Policy and Cookie Policy, are the entire agreement between you and us regarding the website and the free tier. You may not assign them without our consent; we may assign them to an affiliate or a successor. No waiver is implied by delay.
